Q: What can residents do to stop loud late night parties?

A: Depending on call volume, DeKalb Police will respond to noise complaints at all hours of the night. On a first complaint, officers typically will talk with both parties involved to rectify the situation amicably. If there is a second call in the same night, or if there is an ongoing noise issue at a residence, officers can issue a citation to the homeowner/resident.

Q: What can residents do to stop incessant dog barking?
A: According to city of Tucker and DeKalb County ordinance, pets cannot vocalize (bark) for more than 15 minutes without interruption or for more than 30 minutes if the noise is intermittent. If the noise occurs during the overnight hours, residents can take audio or video recordings, documenting the date, time and duration. They can then turn that evidence over to Tucker’s code enforcement officer, who will issue a notice of violation. If an additional complaint is received, the code enforcement officer can issue a citation.

Q: What can residents do about noise from fireworks?
A: It depends. Fireworks are regulated by the state of Georgia and are legal for use seven days a week from 10 a.m. until 9 p.m. The only exceptions are New Year’s Eve (legal until 1 a.m.) and July 3 and 4 (legal until midnight). If someone is setting off fireworks outside of the permitted hours, you can call the police.

Because fireworks are regulated by the state, cities cannot ban them. Local officials are able to use zoning law to regulate where fireworks are sold, as well as to enact taxes on fireworks. Additionally, Georgia’s law states that it is illegal to use fireworks within 100 feet of hospitals, nursing homes, gas stations and parks.

Q: Is there any limitation on noise from construction projects?
A: Yes. According to city of Tucker and DeKalb County ordinance, construction is only permissible Monday through Friday from 7 a.m. until 7 p.m. and Saturdays from 8 a.m. until 5 p.m. These parameters also apply to demolition and deliveries. Additionally, construction is not allowed on holidays.
